WILL
A will or testament is a legal document that expresses a person’s wishes as to how their property is to be distributed after their death and as to which person is to manage the property until its final distribution.
PROCEDURE FOR REGISTRATION OF A WILL?
• • Normally a Will is signed at the home/office of the person in presence of two witnesses and Registration of a Will are often done during lifetime after a Will has been signed.
• • Will is to be registered at the office of Sub-registrar of Assurances which is within the jurisdiction of the residence of the one that made the desire . There are not any government fees for registration of a Will except scanning and photocopy charges which is extremely nominal.
• • The testator must be personally present at the Sub-registrar’s office along side two witnesses.
• • Registration of a Will normally takes a maximum of up to 30-45 minutes, however preparation may take 3 days for documentation, witnesses and appointment at the Sub-registrar’s office
DOCUMENTS REQUIRED FOR REGISTRATION OF WILL?
• • The person making the desire has got to personally attend the Sub-registrar’s office with 2 passport size photographs.
• • A Mental Fitness Certificate of the Testator from an MBBS / MD Doctor.
• • Original Signed Will.
• • Two witnesses must even be present with their 2 photographs.
• • Photo proof of one that has made the desire .
• • Photo proof of the 2 witnesses.
• • Address Proof of the one that has made Will.
• • Pan Card of Person making Will also as of two Witnesses.
WHO CAN GET ACCESS TO THE REGISTERED WILL?
• • Inspection of Will isn’t allowed to public
• • Only the one that has made the desire can get a replica from the Sub-registrar’s office.
• • After the death of the person, his/her loved one or the executor can get a replica of the desire after due verification of their identity.
